Service Agreement
This agreement is between the “Company” Blitz Organization and “Client”.
Blitz Organization will provide professional organizing services with the goal of creating an orderly and efficient space that is customized for you, the Client. This letter is to confirm the details of our agreement, including the systems and services provided by our professional organizing company.
The Parties agree to the following:
Services
Company provides professional organizing services and agrees to deliver services to Client that encompass, but are not restricted to:
- Evaluating the current condition of the Client’s space and suggesting ways for enhancement.
- Crafting a strategy for organizing and decluttering the Client’s space.
- Executing the plan by organizing and decluttering the Client’s space, which may involve the use of purchased organizational products.
- Providing advice to the Client regarding ways to maintain their organized space.
Service Area
Company is located in the greater Sacramento area and provides services to clients in the following counties: El Dorado, Placer, and Sacramento. Our service area covers a 50-mile travel radius from our headquarters in El Dorado Hills, California. Travel time is determined using standard commute calculations. For areas beyond our service radius, a travel fee is subject to be charged depending on location. Please note that we do not charge for travel time delays caused by construction or traffic.
Fees & Terms of Payment
Client agrees to pay Company a fee for the following:
- Project management costs (including planning, shopping, receiving shipments of items purchased, unboxing and quality control of items purchased, and donation drop-off). Please note Company cannot handle hazardous waste, electronics, paints, liquids, tires, or large items that need specialized disposal as part of our regular trash removal service. These items may require a third-party service, which will be charged at an additional fee.
- Trash haul away
- Organizing services including categorizing & sorting all items in a space, assisting with the decluttering process, organizing, labeling, and hauling all donations, recycle, and trash away.
- Plus, the cost of any items ordered and used to organize or improve the space.
- Maintenance or Refresh sessions are available after a project ends at the rate of $125/hour. This price reflects a 15% exclusive to past clients only and can be used for spaces only previously organized by Company.
Client is responsible for the timely and full payment of all prices and fees. A 50% deposit of the estimated organizing hours & supplies is due at the time of signing the contract in order to book your project. The remainder of actual organizing hours and the actual cost for container fees + behind-the-scenes fees are due when you receive the final invoice, typically 1-2 days after the project is finished.
Payments may be made by cash, check, Zelle (9162340077), Venmo (@blitzorganization), or credit card. Checks should be made out to: Blitz Organization LLC. Client will be charged a $25.00 returned check fee for any check that is returned, no matter the reason.
Default in Payment
Payment is due on the last day of the project or on the day a final invoice is presented. If Client does not make a payment on the due date, Client agrees to pay interest on the overdue amount at a rate of 2% per month, compounded monthly. Furthermore, Client agrees to cover any costs associated with collecting the unpaid amount, including collection and legal fees, disbursements, taxes, and other charges.
Cancellation Policy
Our cancellation policy is based on mutual respect for each other’s time (Client and Company) and appointment commitments.
When Client books an appointment with Company, that time slot is reserved exclusively for the Client and becomes unavailable for others. The Company requires 72 hours advance notice, except for true emergencies, of any appointment change or cancellation via telephone or email. Cancellations within 72 hours may be subject to a full session charge if Company is not able to rebook the slot.
Cancellations made with more than 72 hours notice are eligible for complimentary rescheduling.
The Company will wait for 15 minutes past the scheduled appointment time at Client’s onsite location. After 15 minutes, Client is considered a no-show, and that session is forfeited.
Donations, Trash, and Property Removal
The Company is not accountable for any regrets regarding donations or trash. The Client must approve all items designated for donation or disposal before they are taken from the premises. The Client always has the ultimate say in deciding whether to keep, donate, or dispose of items; therefore, the Client understands and accepts that if they ask the Company to remove items from their property, they relinquish any potential claims against the Company for losses or damages associated with those items.
Confidentiality
All Client information, including personal details, organizing preferences, and any sensitive materials encountered during our work together, is treated with the utmost confidentiality. The Company is committed to safeguarding Client privacy and ensuring that Client information remains secure and protected at all times.
Access to Job Site
Client acknowledges that they have control of the job site and agree to grant Company access throughout the duration of the work. The client will provide access to the property or keys and/or access codes if needed, which is convenient for both the Client and the Company to perform the services. If access is provided only as needed, and the Client fails to leave a key or access means, there will be a charge of at least $100. The Company will take reasonable steps to safeguard the Client’s keys and access codes. Entry to the Client’s property will occur only after providing advance notice through phone, email, text, or voicemail.
Client Preparation
Before each organizing session, the Client is responsible for making the following preparations:
Sensitive Materials: Remove any sensitive materials from the room or area to be organized. These may include financial records, legal documents, confidential papers, mementos, cremation ashes, religious icons, or any other valuable or personal items that you do not want others to see or handle. If there are specific areas or items within the space that you want to keep untouched or unmoved, please inform the Company before the session begins. Highly breakable or sentimental items should also be removed prior to each session.
Firearms: Before each session, either entirely remove firearms from the area to be organized or securely store them in a designated space. If you choose to store firearms instead of removing them, please inform the Company before the session starts and specify where the firearms are stored. The Company will not handle or move firearms, and the Client is not allowed to interact with firearms during the session.
Pets: We adore your furry friends, but for their safety and well-being, we kindly request that you secure them in an area of your home that is not in the space(s) we are organizing. Our team will be moving in and out of your space and home, and this precaution is to prevent any accidental escapes or injuries. Your pets’ safety is our top priority.
Client Involvement
While the Company can certainly organize the Client’s spaces without the Client’s presence, the Company recommends that the Client be available during the session if the Client would like to provide input. If Client cannot be present, the Company asks that the Client be available by phone in case of questions or for making decisions about items to keep, toss, or donate.
Disclaimer
The Company does not provide moving services, house cleaning, or furniture assembly services. We will do our best with safety being a priority; however, if there are heavy items such as large furniture, cabinets, boxes, or other items that need to be moved, rearranged, or assembled during the project, it is the Client’s responsibility to have someone available during their session(s) to handle these tasks.
Non-Solicitation
During the Term of this agreement and for a period of two (2) years following the expiration or termination of this Agreement, Client shall not, directly or indirectly, hire, solicit, or attempt to hire or solicit any employee, contractor, or consultant of Company to (i) provide services to Client; (ii) leave their employment with Company; or (iii) work for any individual or entity other than Company. Client shall not induce or attempt to influence any client, vendor, professional, or any other person or entity with a business or other relationship with Company to modify that business or other relationship in any manner.
Photo & Video Release
Client gives Company permission for the use of their testimonials, along with before & after photos and/or videos of their space(s), taken with their consent, in marketing materials. These materials may include print and online advertising, such as social media and company website. The photos and/or videos will not include the Client, anyone in the household, sensitive information, or anything that could identify the Client. Additionally, Clients release Company from any claims or demands related to the use of these photographs and/or videos.
Garage Sign
Company will place a marketing sign on the Client’s sidewalk during a garage organizing session. The sign will direct any passersby to contact us should they be interested in our services. Company will install the sign upon arrival and remove it upon departure.
Termination
Either the Company or Client may terminate this Agreement with reasonable advance notice to the other party. If terminated, Client is responsible for paying any outstanding fees incurred before the termination.
The Company reserves the right to discontinue an organizing project at any point under certain circumstances, including but not limited to, unsafe or unhealthy working conditions, as determined solely by our discretion (such as pest infestations or severe weather), Client breaches of the agreement (e.g., non-payment), or situations where Company is unable to provide requested services through no fault of our own.
Relationship or Parties
The Company is an independent contractor engaged to deliver services to the Client. This Agreement does not establish an employment, partnership, joint venture, or agency relationship, and neither party is authorized to bind the other to any agreements with third parties. This Agreement does not confer any third-party beneficiary rights.
Liability
Client agrees not to hold Company or any of its owners, employees, agents, or contractors liable for any unintentional damage or lost items that may occur during the performance of services under this Agreement. Company does not provide warranties or guarantees for the performance of any products provided to the Client as part of our services, including organizing supplies/equipment and storage containers.
Severability
If any part of this Agreement is found to be against the law or not legally valid by a court, the other parts of the Agreement will still be valid and enforceable.
Governing Law
This Agreement shall be governed by the laws of the State of California.
Therefore, the parties, having carefully reviewed the preceding Agreement, fully comprehend its contents, and willingly accepting its terms, hereby sign and execute this Agreement.
